1. Acceptance of Terms

By downloading, installing, or using ScanTrans (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

2. Description of Service

• Processes images to extract and translate text
• Provides translation services through third-party AI models
• Stores translation history and data locally on your device
• Requires an internet connection for translation services

3. Subscription and Payments

• The App operates on a subscription basis. Subscription terms and pricing are displayed before purchase.
• All payments are processed through Apple's App Store. You can manage and cancel subscriptions through your Apple ID settings.
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
• Refunds are handled according to Apple's standard refund process.

4. User Responsibilities

• Use the App for lawful purposes only
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App for any unauthorized commercial purposes
• Not upload illegal, offensive, or inappropriate content
• Be responsible for all activities conducted through your device

We reserve the right to refuse service, suspend, or terminate your access to the App if we determine, at our sole discretion, that any images you upload contain content that violates Canadian law or is otherwise illegal, offensive, or inappropriate.

5. Content Verification Responsibilities

• Independently verify all AI-generated content before relying on it
• Not use the App for critical decisions without proper verification
• Exercise reasonable judgment when using AI-generated content
• Accept full responsibility for any actions taken based on AI-generated content
• Not hold the App or its developers responsible for any consequences of using AI-generated content

6. Disclaimer of Warranties

• The App and its services are provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not guarantee 100% accuracy of translations or uninterrupted service.
• AI-generated content may contain inaccuracies, errors, or be incomplete. You are solely responsible for verifying the accuracy and appropriateness of all results.
• The App is not suitable for legal, medical, or other professional translations.

7. Limitation of Liability

• We are not liable for any indirect, incidental, or consequential damages.
• Our total liability shall not exceed the amount you paid for the App in the past 12 months.
• We are not responsible for losses resulting from translation errors, AI interpretation errors, inappropriate or inaccurate AI-generated content, decisions made based on AI-generated content, service interruptions, data loss, or unauthorized access to your device.

8. Intellectual Property

• The App and its original content are protected by copyright and other intellectual property laws.
• You may not copy, modify, or distribute the App's code or content.
• You retain rights to your uploaded images. You grant us limited permission to process your images for translation purposes only.

9. Privacy and Data Protection

• Our Privacy Policy explains how we handle your data.
• We do not store your images or personal data on our servers.
• All image processing follows our "no-landing" policy.
• For translation purposes, your selected image and approximate location (e.g., country or region) may be sent to third-party AI service providers. This information is not associated with your identity.
• The App uses your device's identifier (UIDevice.current.identifierForVendor) solely as a technical user ID to fulfill server requirements. This identifier is not linked to any personal information.
• Local data is deleted upon App uninstallation.

10. Modifications to Service

• We reserve the right to modify or discontinue the App at any time
• Change subscription fees with notice
• Update these Terms of Service
• Modify features and functionality

11. Termination

• We may terminate or suspend your access to the App for violations of these Terms, for fraudulent or illegal activities, or at our sole discretion without prior notice.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.

13. Dispute Resolution

• Any dispute arising from these Terms shall be resolved through good faith negotiations, in accordance with Canadian law, and in courts of Ontario, Canada.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

15. Indemnification

You agree to indemnify and hold us harmless from any claims resulting from your use of the App, your violation of these Terms, or your violation of any third-party rights.

17. Apple App Store Terms

• These Terms are between you and ScanTrans, not Apple.
• Apple has no responsibility for the App or its content.
• Apple's App Store Terms also apply to your use of the App.

18. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of new Terms.

19. Export Control

You may not use or export the App in violation of Canadian export laws and regulations.

20. Survival

All terms that should survive termination of these Terms shall continue in effect.

21. Entire Agreement

These Terms constitute the entire agreement between you and ScanTrans regarding the App.
